The Pending “TAKE IT DOWN ACT” For Revenge Porn

The United States Congress is working on a new bill to combat revenge porn. The bill is called “The Tools to Address Known Exploitation by Immobilizing Technological Deepfakes on Websites and Networks Act “, otherwise known as the “TAKE IT DOWN ACT The bill criminalizes the publication of non-consensual intimate and sexually exploitative images published on social media and online platforms, including AI-generated deepfakes.

While almost all states have laws protecting individuals from non-consensual intimate images, they all vary in how the crime and penalty is classified. Within California, we have our own revenge porn laws. See California Penal Code Section 647 (j)(2) which prohibits a person from using a concealed camera to secretly record an identifiable person without that persons consent or knowledge, with the intent to arouse or gratify the lust or sexual desires of the perpetrator. See also California Penal Code Section 647 (j) (4)(A) which prohibits intentional distribution of intimate images of an identifiable person.
