Disability Discrimination in the Workplace, Duty to Accommodate Disability, and Failure to Engage in the Interactive Process
In California, it is illegal for an employer to discriminate against you because of a physical or mental disability. Furthermore, employers are required to reasonably accommodate physical or mental disabilities of employees unless the employer can show that such an accommodation would result in undue hardship to the operation of the business.
Once you have given your employer notice of your disability, they are obligated by law to engage in a timely, good-faith interactive process with you to determine an effective reasonable accommodation. However, the employer cannot be held responsible for failing to engage in the interactive process if no reasonable accommodation is possible.
